Summary/Abstract: The definition under all aspects of the legal function relationship also implies the clarification of the notions of responsibility and liability of the civil servant. Clarification of the two notions with different content is also required from the different perspective of their approach in the science of administrative law. Thus, the notion of responsibility has in mind the social relationship within which the civil servant carries out his activity. In contrast to legal responsibility, which takes on forms specific to each branch of law depending on the qualification of the act of the civil servant whenever he violates legal norms, legal responsibility is what Prof. Antonie Iorgovan1 defines very conclusively as: “the conscious active reporting of the agent of social action to the norms and values of the collectivity, established on a macro or micro-social scale”. In other words, responsibility is actually the attitude that the civil servant has in relation to the authority but also to the citizen, an awareness of his increased obligations through the prism of specific attributions. Responsibility appears to us more as an event of a volitional and educational nature, something that is acquired over time, consciously, that can be shaped by perfecting the civil servant who must be “taught” to face any factual situation with which he comes into contact at any time in carrying out the specific duties of the public office. The awareness of responsibility is a gain both for the civil servant, who becomes competent quickly, but also for the institution, which in this way can carry out the tasks for which it was established, and last but not least for the citizen who applies with all confidence in order to satisfy his interests.
