Order of intestate succession in the fourth level

Summary/Abstract: The fourth level of intestate succession, introduced by Art. 8, Par. 4 ofThe Inheritance Act, establishes a succession procedure, causing difficulties, arising fromsome deviations from the rules, applicable to the succession in the first three levels. Thislevel includes distant relatives of the lateral line, which often waive their hereditary rights.Therefore, the formulation of a clear and understandable algorithm, which can be appliedto the passing of the inheritance rights of heirs of the lateral line from the third to thesixth degree, is of significant importance. This algorithm can be optimized by introducingprinciples, known in the legislations of other countries.Keywords: inheritance law; intestate heirs; waiver of other countries.
