Summary/Abstract: Derogation from the general rules, especially from the material competence, the competence according to the quality of the person presents elements of continuity, which are faithfully reproduced by the jurisprudence shown in this paper.. Regarding lawyers, a particular hypothesis has caused divergences in the practice of the courts, raising the issue of identifying the procedural rules that are applicable to them in the case of suspension from the profession. In a majority proportion, as it resulted from the jurisprudence examined, the courts appreciated that these data do not influence the application of the special rules provided by the procedural norms. By Decision no. 23/2022 of 14.11.2022, pronounced in an appeal in the interest of the law, the High Court of Cassation and Justice, which refers to the activity actually carried out by the magistrate, removing from the benchmarks for establishing competence the aspects regarding the professional degree held by him. However, this reasoning indirectly determines the reduction of the analysis, is in the case of lawyers, to the performance or not the specific activity at the time subject to verification.
