The criminal offence of “specific lying”

Summary/Abstract: Since the entry into force of the Fundamental Law, there has been no case law analysis of the public denial of the crimes of the National Socialist and Communist regimes. We therefore reviewed the relevant case files of the Chief Prosecution Office of the Capital and processed the eight cases found. On the basis of these, we present the domestic practice and its anomalies, compare it with the practice of the European Court of Human Rights, and present the relevant decision of the Constitutional Court.
