Some aspects of the enforceability of the judgment ordered in accordance with the Law no. 554/2004 as to the administrative litigation

Summary/Abstract: Setting a final judgment to execution ordered pursuant to the administrative litigation Law requires compliance with pretrial procedures imposed by special law, depending on the obligations contained in the enforcement title; procedures that sometimes depart from the Code of civil procedure, and are sometimes supplemented by its provisions. It should be noted that in this case, we are under an exception to the rule according to which the appeal is not suspensive of execution and turnaround times of obligations under enforcement orders pronounced on this matter create excessive protection to the debtor – public establishment.
