Legal Protection of Historical Memory and its Pitfalls

Summary/Abstract: The article deals with selected aspects of the memory legislation of the Slovak Republic by outlining and critically reflecting on its criminal and non-criminal elements. It identifies the risks that Slovak criminal protection of historical memory poses from a freedom of expression perspective, while proposing how to mitigate these risks. It considers the main contribution of the suggested changes to be the strengthening of the right to freedom of expression and an increase in the democratic legitimacy of the Slovak criminal protection of historical memory.
