Fideicommissary Substitutions (Gradual Gifts) in Romanian, French, and English Law

Summary/Abstract: In this study, we will analyse the institution of fideicommissary substitution. The fideicommissary substitution of Roman origin has determined numerous controversies over time regarding important principles such as the limits of the right to dispose of through gratuitous transfer, the prohibition of acts regarding an unsettled inheritance, and the conservation of grand estates. For this private comparative law study, we will follow the structure of the seven steps that are specific to the hermeneutical method of the organic law school.
