APPLICATION OF THE INSTITUTE OF LIMITATION OF ACQUISITION REGARDING LEGAL ENTITIES

Summary/Abstract: The purpose of this paper is the correct application of the substantive lawrelated to the elements of the factual composition of the statute of limitations, the presumptionof Art—69 of the Civil Code, both concerning the possessor and the presence of possession inco-ownership. The issues related to the invocation of an already expired statute of limitationsin favour of the possessor and the legal consequences, as well as the possibility of waiving thisexpired statute of limitations, are considered.
