Summary/Abstract: This article aims to explore the issue of criminal liability of the instigator and accessory in the unknown perpetrator scenarios. For this purpose, the concept of „accessory“ has been clarified, the available jurisprudence related to the complicity institution is analyzed and some conclusions are presented regarding the liability of accessory accomplices in cases where the perpetrator is unknown.
