Summary/Abstract: The development of the market economy in modern society implies the so-called free market as an area in which market and economic mechanisms operate, the most important of which are the law of supply and demand and free competition, because they ensure the development of normal market flows. Preservation of competition on the market necessarily requires adequate legal framework aimed at preventing, that is, deterring market participants from actions that would represent a competition infringement. Although competition in the world has been enjoying administrative and civil law protection for several decades, it has proven necessary to extend it to criminal protection as well. In this paper, the authors deal with issues of criminal law protection of competition and restrictive agreements in the Republic of Serbia with an emphasis on the specifics of the criminal offense Conclusion of a restrictive agreement, as well as the role of the Commission for the Protection of Competition.
