Summary/Abstract: This contribution highlights the challenges of the protection of artistic freedom by the European Court of Human Rights in Eastern European countries. Diminished by a lack of clear definition, artistic freedom is the target of explicit and implicit attacks by public authorities, elements that make the work of the Court more complex. The study of European case law also shows that the protection of artistic freedom implies the guarantee of a balance between the preservation of democratic requirements and the protection of morality. This balance is difficult to grasp due to the subjective nature of art.
