Summary/Abstract: Through the analysis of the judgment delivered on 2 May 2023 by the Strasbourg Court against the Russian Federation, concluding to the violation of Article 3 of the European Convention on Human Rights, this study aims to highlight the existence of an informal normative order within the Russian penitentiary system in violation of fundamental rights guaranteed both by national law and by international treaties regularly ratified by the respondent State. The exclusion of the Russian Federation from the Council of Europe raises questions about the possible consequences in terms of protecting the rights of prisoners within this complex prison system.
