CREATION OF NEW WORK LEGISLATION THROUGH DIGITAL WORK PLATFORMS

Summary/Abstract: It is estimated that around 29 million people work through digital work platforms in the EU. This number is growing rapidly and is expected to reach over 43 million in 2025 (an increase of around 52%). The digital work platform engages the executor of the work for the client and thus “brings them together” and organizes the work. It is about all jobs: taxis, deliveries, household services, professional services, micro jobs and others. The largest number of persons who perform the mentioned tasks are “classified” as self-employed personnel (about 93%). It is necessary to record, edit, and strengthen the legal security and responsibility of the entities in the aforementioned relationships. The adoption of a directive of the European Parliament and the Council of the EU in improving working conditions in work through work platforms is in the process. In the Act on Amendments to the Labor Act in the Republic of Croatia (“N.N.” 151/22, 64/23) the specific labor relations of workers who work through digital work platforms, as an employer, are regulated (mandatory content of the employment contract, protection of the safety and health of workers at work, privacy protection, professional communication and other rights and obligations). This paper describes the creation of new regulations and the regulation of work through digital work platforms.
