Summary/Abstract: Looking at the ambitious goal set by the European institutions of an anthropocentric, inclusive, sustainable and more prosperous digital future, this contribution aims to focus on Italian legislation on health and safety at work to reflect on its ability to cope with the prevention and management of psychosocial and organisational risk factors connected to the digitalisation work processes. Health protection at work is examined taking into account the remedies offered by the civil liability system and by the compulsory insurance against accidents and occupational diseases. The analysis is carried out by highlighting the increasingly relevant contribution that jurisprudence offers in preserving and guaranteeing full and effective protection of (also) the mental health of workers.
