Summary/Abstract: In this work, the mathematical model for the choice of an appropriate contract form derived from the Game Theory is used. The problem can be considered as a two players game with asymmetric and nonperfect information, which includes a principal investors and a firm awarded by the contract. Mathematical model gives the optimal solution for the choice of an appropriate contract and is analyzed within the paper. Data are acquired from several governmental institutions to show a possible different way of the contract selection comparing to the fixed-price contract, the model which is frequently used. The work gives a detailed analysis of the relative savings for each given project. By the assumption of the rational players and the fair-play game, the analysis shows the possibility to decrease the expected total cost not only if the optimal model is used but also a simplified one that is proposed in the paper.
