Summary/Abstract: Tele working is a modern method of conducting activity, which involves the modification of the classical relation of the employee’s subordination towards his or her employer, turning it into an employment relationship which is rather a cooperation relationship. Starting from the definition of the concept of tele working and continuing by emphasizing the characteristics of the individual employment agreement in the tele working regime in compliance with the provisions of Law no. 81/2018, this article aims at examining, considering also the regulations of comparative law, if it is possible and necessary to implement tele working in the Romanian public sector. Although there are disadvantages and difficulties related to implementation for the exercise of the activity in the public sector in the tele working regime, this is a method of work organization which is necessary in certain situations. Moreover, the development of the information technology and communications involves major changes in the daily life and activity, and the state, no matter how conservatory it is, should adjust to these changes and change the method of the activity organization for the benefit of its citizens. And considering the advantages which this method of flexible activity organization has both for the employee and for the employer respectively the experience regarding the tele working implementation during the state of emergency, it is possible to conduct the activity in this way, at least partly, in the Romanian public system.
