FORM FOR VALIDITY OF COMMERCIAL TRANSACTIONS IN THE PRACTICE OF VKS

Summary/Abstract: The stability and security of commercial transactions is of primary importance in commercial relations. The Commercial Law contains provisions governing the particularities of commercial transactions, which are dictated by the ideas of speed, simplicity and security in commercial turnover.The subject of this report is the question regarding the form of reality of commercial transactions. The form provided for in the provision of Art. 293, para. 1 of the Commercial Law is about the validity of commercial transactions. The aim is to analyze the special hypotheses established in the Commercial Law regarding the form of commercial transactions and the specific consequences that find expression in the practice of the Supreme Court of Cassation.
