Summary/Abstract: Equality is one of the fundamental values of contemporary society, but its realization often requires action beyond the formal concept. This paper explores the conceptual framework of positive action in international law, with a particular focus on the difficulties and challenges in defining this concept. By analyzing international and European legal instruments, the paper identifies the essential determinants of positive action, including its temporary character, objectives (achieving full equality) and forms, from the promotion of equal opportunities to preferential treatment, while highlighting the challenges in determining the content and scope of these elements due to different legal, cultural and social contexts, as well as possible future directions for the development of this concept.
