Summary/Abstract: The new Law on Compulsory Traffic Insurance has recently entered into force in the Federation of Bosnia and Herzegovina. The most significant changes introduced by this Law are those related to the protection of third parties – victims of traffic accidents who are entitled to compensation for damages under the compulsory motor liability insurance against civil liability in respect of the use of motor vehicles. The authors present the extent to which the Law has achieved harmonization with the EU acquis and whether internal national harmonization of regulations in this area has been achieved. In addition to the above, some particularly important provisions of the Law regarding the protection of injured parties are analysed. The legal provisions determining who is considered a third party are explained as well as the minimum coverage limit under a motor liability insurance contract, and a brief overview of the insurer’s obligations in resolving claims are presented. The importance of the Framework Criteria for determining the compensation amount for injuries or death, which are an integral part of the Law and differentia specifica in relation to the reference regulations in the region and beyond, was emphasized.
