Referendum in Ukraine: theory and practice

Summary/Abstract: The paper is dedicated to problems of the development of referendum institutions in Ukraine. The author concentrated his attention on the analysis of advantages and disadvantages of Ukrainian referendum legislation features and its application in Ukraine. On the basis of analysis the author makes a conclusion that today’s law „About All-Ukrainian and Local Referendum” in force emands making considerable alterations and updates because most of its enteries do not correspond to the Constitution of Ukraine and democratical standards. In this case it is difficult to state that art. 5 of Constitution of Ukraine, which proclaimes that the holder of sovereignty and the only source of power in Ukraine are people, is fulfiled.
