Summary/Abstract: Lineage represents the connection between a child and his parent. The lineage towards the father, or the paternity is based on the fact of conception, while the lineage towards the mother or maternity is based on the fact of birth. The regulation of lineage recognition within the Civil Code stands out, first by unifying the rules on the lineage recognition a single section, regardless whether the lineage recognition is done by the mother or father. In the Family Code, the maternal lineage recognition was treated separately from the paternal one, and this generated divergent views as to the application of certain legal texts and created the premises for an absolutely unjustified discrimination between parents.
