The Developement of the Criminal Judiciary in the European Union

Summary/Abstract: In year 2009 the European Parliament recommended to the Board of European Union, to begin dealing with protection of fundamental rights in consideration of the fact that section of criminal justice in European union must be based on respecting of fundamental rights. This concerns also adopting a legal tool with procedural guaranties in criminal proceedings based on presumption of innocence, as well as right on „bill of rights“, right on legal aid, if necessary free legal aid right during pre-trial proceeding and proceeding in front of court, right to provide evidence, right to an interpreter, right to be heard, right to defense, protection of accused, who do not understand the meaning of criminal procedure or which can not observe this procedure, maximum limits by detention, conditions and protection of youthful accused, as well as effective and available mechanisms of appeal procedure for individuals.
