Summary/Abstract: This article concerns one of the most important question related to the application of the Article 5 point 3 of the Council Regulation (EC) No 44/2001 of 22 December, 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. This provision establishes the jurisdiction of courts of the European countries in matters relating to torts (delicts). Thus, the correct interpretation of the term „place where the harmful event has occurred” has a great weight for a practical application of Article 5 point 3, because it determines a real scope of this provision. The author of this paper presents main lines of interpretation of this term in the light of the completed jurisprudence of the European Court of Justice and opinions of both the Polish and European doctrine. Especially, he points out that the interpretation of the above mentioned term should assure, first of all, efficient justice administration in the EU member countries, and can not be only treated as a kind of unjustified aid for the claimant.
