Outlook for internet voting in the Republic of Poland

Summary/Abstract: In this article the author considers the possibility of using the Internet voting (herein after also referred to as i-voting) in the Republic of Poland. Particular attention is drawn to the provisions of the Polish Constitution of 2 April 1997. His findings are based on particular methods of voting that are currently being used, i.e., postal voting and voting by proxy. They feature similar characteristics to the i-voting, so the findings made so far in the doctrine and case law, specifically in the judgment of the Constitutional Court of 20 July 2011, ref. K 9/11., are regarded as helpful. Furthermore, the author draws attention to some social phenomena, which also cannot be indifferent to the legislator designing future solutions. In addition, certain aspects are discussed in other applicable rules of law, which are in connection with the mentioned above way to vote. In conclusion, the author states that in his opinion i-voting is permitted under applicable provisions of the constitution. If however, in the course of further discussion the applicable constitution does not allow i-vote where to find, one would think about changing it. Further delay in the introduction of such a method of voting may result in a gradual turnout reduction.
