Summary/Abstract: Although the archive material is not cultural property neither by the manner of custody over it or its research and use, it is primarily treated as such in most European countries. Also, unlike museums, galleries, theatres, cultural monument protection agencies, the Archives are not primarily cultural institutions in order to be under the jurisdiction of the departments of culture. The archive material should be primarily permanently protected, which is the reason why it should be placed under the jurisdiction of state institutions to ensure the highest levels of protection and safety. Under the Succession Agreement of 2001, specifi cally Annex D: Archives, the archive material in the SFRY State Archives is largely “common heritage” of successor States of the former SFRY. Certain irregularities which have been observed in the research and use of the archives by the professional archivists from the successor States of the former SFRY, should be removed or reduced to the smallest possible extent. In order to ensure effective protection and safety of the archive material as “common heritage” of successor States of the former SFRY, the Archives should perhaps be placed under the jurisdiction of other state institutions on the republican level in the Republic of Serbia.
