Summary/Abstract: The unauthorized exploitation of someone else’s property is usually given as an example to describe the assumption of unjustified enrichment. The article starts with a brief review of the recent case law and draws attention to the fact, that the claimant’s impoverishment is rarely scrutinized by the court. The author continues then with the exploration of the doctrinal views on impoverishment as a precondition of the unjustified enrichment claim and discusses the usefulness of the concept in the aforementioned cases.
