Legal opinion regards governmental draft law amending the Civil Code (paper 3595).

Summary/Abstract: The purpose of the proposed changes is to extend the provisions regulating acquisition of transmission easements (servitudes) by entrepreneurs. The transmission easement may be established for an entrepreneur on another person’s real estate when entrepreneurs transmission infrastructure is installed on this real estate. Generally extension of the provisions on the transmission easement deserves approval and is needed for various kinds of entrepreneurs (for example gas and power suppliers). However some of the provisions proposed in the project are controversial, especially the provisions allowing for a retroactive acquisition of an easement.
