On historical development of the institution of legatum per vindicationem in Russian law after the partition of Poland

Summary/Abstract: This article is dedicated to the issues of post-mortem succession and understanding of the testamentary legacy institution in the Russian Imperial Law, which was in force during the Partition of Poland and before Poland declared independence. The text presents three different approaches to understanding the essence of testamentary disposition in Russian law. The main question for discussion is whether or not the law allowed for legatum per vindicationem. The author also shows the link between the legal questions discussed in the past and the institution of vindication legacy under modern Polish law. The questions surrounding testamentary succession under Russian law can be useful for discussing the theoretical classification of the institution of legatum per vendicationem as a part of the common approach to succession under the Polish law.
