Summary/Abstract: The study named The Right of Inheritance Option intends to analyze the institution of inheritance option, a fundamental institution of the inheritance law. In fact, only after exercising the option in the sense of accepting inheritance, the prospective successor, who acquired the capacity as successor with solvable title as of the date of opening inheritance, consolidates this title, along with all the powers conferred by it, including those related to the capacity as owner of the successor over the inheritance property. We will see that every rule with value of principle has its exceptions. Finally, we will find that the lawmaker’s options in choosing one regulatory way or another are and remain sovereign even if, sometimes, some choices might be questionable.
