The legal nature of enjoyment exercised by the lessee

Summary/Abstract: Attempting to participate in a controversy and, possibly, to settle thereof, the study argues that the enjoyment of property by the lessee is covered neither by an obligation of a lessor, nor by a real right of the lessee. It consists in the exercise of the freedom of action of the lessee, freedom which can manifest itself on the property following its valid submission upon the agreement’s execution and within the limits deriving from the obligations undertaken by the lessee thereunder.
