Summary/Abstract: Even if, consistent with the fundamental law, „the treaties approved by the Parliament, in accordance with the law provisions, are part of the national legislation”, there are numerous cases when a deadlock is reached, the cause being the different ways to interpret the legal stipulations. As we try to approach this subject, we will start from the constitutional principle, according to which „the Romanian state is bound to accomplish exactly and in good-faith the obligations that rise from the treaties Romania is part of”. In our endeavor, we will study a real case, from the operation theaters, where such phenomena occur.
