COERCIVE MEASURES – NEW REGULATION IN POLAND

Summary/Abstract: The article describes new regulation on coercive measures (including firearms) in Poland, implemented by the act on 19th of April 2013. For the first time we can find almost all directives and norms regarding above mention measures in one act. There’re two reasons for that. Firstly: because of verdicts of the Constitutional Tribunal (dated 2010 and 2012) by which the court has questioned and declared previous law as unconstitutional, existing in the same or similar form in many acts and regulations. Secondly: to create homogeneous catalogue of coercive measures and methods, conditions and circumstances to be used by more than twenty services and hundred thousand officers (soldiers, workers, guardians etc.) which have right to do it. The new law enter into force in June 2013. Because of that since 5th of June in Poland there’s a new situation regarding above mentioned matter, former law is abolished and a lot of acts are amended. The act on coercive measures and firearms would be for sure new challenge for people responsible for protecting public order and safety.
