Summary/Abstract: The new civil Code, accomplishing the monistic concept by the unification of the provisions of civil law with the provisions of the commercial laws, generated significant movements both in the matter of the civil contracts, and in the matter of the pre-existing contracts entered into prior to the sale-purchase agreements, and this last category includes also the sale-purchase promissory agreement. In the light of the regulations established by the new civil Code and by the new Code of civil procedure, this study intends to examine certain issues relating to the sale-purchase promissory agreement and to its forced execution procedure, as well as the emphasize on the controversial judicial practice in the matter.
