Summary/Abstract: The importance of the freedom of association for the establishment of the functional democracy is analysed in this article. The significance of the ratification of the European Convention for the Protection of Human Rights and Fundamental Freedoms (2003) was emphasised. The author also analysed the Draft Associations Act which is an attempt to replace the current legislation concerning the field of association of citizens within the new constitutional framework, aiming of maximising this freedom, as well as the prevention of its abuse in the democratic states.
