Determining jurisdiction under Regulation (EC) no. 44/2001

Summary/Abstract: The Brussels Convention of the 27th of September 1968 and subsequent Regulation no. 44/2001 of the 22nd of December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters have created a unified regulatory framework on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters between the signatory states of the two acts. This article envisages general and special jurisdiction in private international law, the exception of lack of jurisdiction, lis pendens and inter connection between cases and the rules that establish jurisdiction.
