Contracts Related to Public Procurements in the Polish Legal System

Summary/Abstract: This article describes Polish legal regulations within the scope of agreements that are applied in public procurements. The manner of forming the content of such agreements is of key significance when it comes to the diligent fulfillment of the subject matter of public procurements, in light of, among others, public financial expenditures. The legal relationship that arises in the pursuance of agreements related to public procurements constitutes an obligation between the parties, the contents of which may be scrutinized by the legislature in accordance with the peremptory norms (ius cogens). The body of the regulations that relate to public procurement agreements is contained in the Public Procurement Act that was passed on 29th January 2004.
