The Vacancy of the Mayor’s Office

Summary/Abstract: This study aims to get the attention of the administrative law doctrine towards a series of problems which occurred relative to the administrative practice regarding the application of the norms which regulate the vacancy of the mayor job. So far, the administrative practice in Romania confirmed the posibility of different and sometimes wrong interpretations and applications of the texts which regulate the exercise of public functions and offices, and also the situation in which a public office becomes vacant and the position is filled by a substitute. Therefore, our demarche aims to highlight the defining features of the positions’ vacancy, but also the lacks in the regulations.
