The Incompatibility in the view of the New Code of Civil Procedure

Summary/Abstract: The New Code of Civil Procedure brings important changes in terms of cases of incompatibility and the ways in which they are revealed and resolved in the civil trial. If absolute incompatibilities cases are almost unchanged, relative incompatibility cases were completed and modified in accordance with the requirements expressed in the doctrine and jurisprudence. More than that, the provisions concerning the abstention and the challenge completes the tendency of normative completeness of the contemporary legislature, without being devoid of the danger of non-unitary interpretations.
