Summary/Abstract: The criminal action, in its normal development, covers three main moments: the initiation, the exercise and the conclusion. The conclusion, as the final moment in the development of the penal action, is defined by the prevention of its initiation or exercise as soon as one of the afferent cases intervene (which can prevent its initiation or exercise). The cases which hinder the initiation or development of the criminal action and, concequently, cause its closure, are based on either its lack of grounds or its lack of object. This study aims to present thouroughly at least three elements likely to outline the problem of teh lack of grounds of the penal action.
