Summary/Abstract: The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal in relation to the constitutional complaint (ref. No. SK 28/12) concerning the Code of Civil Procedure. The author claims that the challenged Article 378 §1 of the Code, to the extent that it requires the court of second instance to take into account – by the operation of law – the nullity of legal proceedings resulting from improper authorization of an attorney only within the “scope of appeal”, is consistent with Article 45 (1) and Article 77(2) of the Constitution.
