On the future of the right of perpetual usufruct.

Summary/Abstract: The opinion deals with the assessment of the need to maintain the right of perpetual usufruct in the Polish legal system. The right of perpetual usufruct is one of the most common right in property, there were more than 1 300 000 perpetual usufructuaries in 2006. The purpose of the new legislative proposals is to remove this right from the legal system. From the perspective of perpetual usufructuary, converting into ownership is favourable, provided that it is not connected with additional expenses. On the other side, from the perspective of the owner of property, converting has negative financial effects. According to the author, the right of perpetual usufruct should be modified as regards its content and purpose. It is a better solution than elimination in order to create a new right with similar content.
