Summary/Abstract: The offensive in the direction of a real legislative novelty, of a New Civil Procedure Code which affirms in a different manner the already established institutions pales, in a more thourough analysis, in front of the consistency of the lawmakers of Law no. 134/2010 in connection to the 1865 Civil Procedure Code. Of course, we do not deny the existance of a legislative contribution of Law no. 132/2010 to the current Civil Procedure Code, but, rather than otherwise, we are in the presence of punctual novelties than a new civil Procedure Code da capo al fine. We do not want to criticize this aspect, on the contrary: the normative patrimony of the 1865 Civil Procedure Code does not have to be ignored, but brought up to date, to the current legal reality.
