Summary/Abstract: Undercover investigators can be used to collect data on the existence of the crime and to identify persons alleged to have commited an offense. It was argued that preceding acts performed by undercover investigators represent a “special investigation procedure, derogatory in several respects from the common law”. We discuss, beyond these legal issues, the reasons that led to the the regulation of this institution in the Romanian Criminal Procedural Law and other ethical issues facing undercover police officers. A delicate problem remains that of the commission of offenses by undercover investigators in the exercise and also the question if it is justified to break the law to enforce it.
