Summary/Abstract: The article examines the growing recognition of the right to a healthy environment and its constitutionalizing which appears to have significant legal consequences. Constitutional environmental protection is incorporated in many european constitutions that explicitly recognize the right to a healthy environment. The insertion of such an environmental right into national constitutions (of states like Romania, France, Greece) elevates not only the importance of the environment but also identifies legal effects (elevating the environmental protection to an equivalent status with other important rights).
