Summary/Abstract: Syndic judge has an active role for insolvency. He has the status of judge of the tribunal and he is nominated by the president of the tribunal from the judges appointed as syndic judges. He performs a public function, interest, organizing and leading throught the insolvency proceeding under the authority of the tribunal. Syndic judge acting in his capacity as magistrate, and not as representative of the debtor or creditors. Consequently, its provisions are binding for both debtor and creditors. In performing its duties, judge will be helped by some special people: insolvency practitioners, experts etc. These persons may be designated by the syndic judge, by concluding, with the determination of remuneration payable to them. Gives the judges ruling that, as appropriate, sentence or conclusion. Syndic judge's rulings are final and enforceable. They can be attacked separately with recourse to the Court of Appeal.
