Summary/Abstract: The article discusses briefly some issues concerning the application of the principle ne bis in idem in Bulgarian criminal proceedings. Next it examines some of the relevant case-law of the European court of human rights in Strasbourg (Gradinger v, Austria and Oliveira v. Switzerland). It then analyses in detail several cases decided by the Court of die European communities in Luxemburg. They concern different aspects of the practical application of the principle ne bis in idem under art. 54 of the Convention implementing the Schengen agreement. Finally, the author tries to look into the future of this principle in EU law, discussing briefly the proposed Council Framework Decision on its application.
