About the set of problems concerning force and governance in the sociological theory of Jürgen Habermas

Summary/Abstract: In this text considering the problems force and governance in the theory of Jürgen Habermas is picked up as a central theme. The results of the reconstruction concerning the discursive theoretical argumentation to discuss the problems of force and governance will be centralised in the combination of constitutional state and democracy in two major aspects: Firstly the democratic constitutional state represents to Habermas a relationship, which is combined with the rational governance as force of the laws in order to legitimate the institutionalization of a democratic public. Secondly Habermas defines the concept of “herrschaftsfreie Demokratie” as a procedure of context coherence to constitute the relationship of norms which play the part of a communicative act and which is formulated as a normative principle of discourse.
