Mediation in Polish Civil Procedure — Ministry of Justice Statistics

Summary/Abstract: On the 10th of December 2005 the amended the Civil Procedure Code came into force, introducing mediation in civil disputes (The Journal of Laws, 2005, No. 172, item 1438). This article presents the results of analyses of the Polish Ministry of Justice data on mediation usage in civil proceedings (i.e. civil, commercial, family and workplace disputes). Methodology of data collection is discussed and then statistics of cases referred to mediation, mediations undertaken, and completed with the agreements approved of by the courts are analyzed. Necessary modification of data collection methods are proposed.
