Summary/Abstract: The issue of animal rights requires the definition concerning its formal nature as well as substantiation in the fi elds of philosophy and ethics. It is necessary to determine what kind of creatures should have rights, on what basis and by whom those rights should be respected. Human rights refer to the privileges and the duties arising from the abiding of those. They are based on the protection of one human being against another, which is the practical implementation of the safety. When we talk about animals we can only determine what animals are entitled to by the rights of nature, without expecting that animals will fulfill any duties that we may require them to fulfill.
