Summary/Abstract: This short study aims to uncover the way the name of moral persons was regulated in Communist Romania. We believe this to be of interest since before the Communist regime Romania was a constitutional monarchy closely following the legal developments of the Western world and applying them to its developing market economy. Since the 1887 Commercial Code remained in existence and commercial companies were still regulated under that law, with the disappearing of all entirely private commercial companies the Communist regimehas created a new set of moral persons – not commercial but civil – to undertake all economic activities. These new moral persons needed names in order to be able to conduct their activities and on the study of the different regulations and their dynamic evolution one can find the aspects that, by enduring under different regulations, appear to be the core justification for the regulation of names of moral persons. Because the commercial implications were to be ignored or denied we can observe upon studying these different regulations that there are features which are constant, or nearly so, over the years and, as such provide a framework for the analysis of the civil component of today’s trade names and business names.
